California’s Comparative Negligence Rule
Every state has different laws regarding negligence and liability in auto accidents. California follows what is known as the rule of comparative negligence. Under this rule, anyone injured in a car accident can recover compensation for their damages, even if they were partly at fault for the incident. However, the amount you are entitled to recover will be reduced by the percentage for which you are found at fault. This percentage is determined by a judge or jury, that is, if your case makes it to trial. Insurance adjusters will often keep the comparative negligence rule in mind when determining a settlement offer.
For example, if you are hit by a another driver who ran a stop sign, but you were driving a bit faster than the posted speed limit at the time of the accident, you may be found to be 10% at fault for the accident. If you suffer damages that amount to $20,000, you will only be able to recover $18,000. This is the full amount, minus the 10% (or $2,000) for which you were at fault.
